Right of withdrawal

If you are a Consumer, you have fourteen calendar days in which to withdraw from your purchase, without having to give any reason for your decision and without incurring any costs other than the direct cost of returning the Device.

When the withdrawal period begins

The withdrawal period begins on the day following the day on which you, or a third party designated by you, take physical possession of the Device.

Where the fourteen-day period expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next working day.

Exercising the right of withdrawal

The Customer must inform Outils OBD Facile of their decision to withdraw by post or email. The Customer may use the model withdrawal form reproduced below, although use of this form is not mandatory.

The Customer must then return the delivered goods within 3 days of sending the withdrawal notice and must bear the direct cost of returning them.

Reimbursement

Where the right of withdrawal is exercised, Outils OBD Facile will reimburse all sums paid, including standard delivery costs, no later than 14 days after receiving the returned goods.

The reimbursement will be made using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees otherwise. Outils OBD Facile is not required to reimburse any additional costs where the Customer expressly chose a more expensive delivery method than the standard delivery method offered.

In the event of late reimbursement, the amounts due will be increased as follows: by the statutory interest rate for a delay of no more than 10 days; by 5% for a delay of between 10 and 20 days; by 10% for a delay of between 20 and 30 days; by 20% for a delay of between 30 and 60 days; by 50% for a delay of between 60 and 90 days; and by an additional 5 percentage points for each further month of delay.

Statutory guarantees

The right of withdrawal is separate from the statutory guarantees. Outils OBD Facile is subject to the statutory obligation to deliver goods in conformity with the contract (Article 1604 of the French Civil Code) and the statutory guarantee against hidden defects (Articles 1641 to 1649 and 2232 of the French Civil Code). Customers who qualify as Consumers also benefit from the legal guarantee of conformity (Articles L. 217-4 to L. 217-14 of the French Consumer Code). Consumer mediation

Unless otherwise provided by mandatory law, any dispute must, before legal proceedings are commenced, first be submitted to Outils OBD Facile with a view to reaching an amicable settlement.
